Alabama's New Squatter Removal Bill

In a recent development, a bill aimed at tackling squatting in homes has progressed through a House committee. Sponsored by Rep. Craig Lipscomb (R-Gadsden), HB 182 underwent revisions after initial concerns were raised during its presentation to the House Judiciary Committee.

Squatting has emerged as a widespread issue across the nation, including in Alabama. Individuals unlawfully occupy homes, falsely asserting rights to reside there, leaving homeowners with limited recourse and law enforcement deferring to the courts. Alabama REALTORS® have thrown their support behind the bill, which draws inspiration from laws implemented in Florida.

The proposed legislation empowers homeowners or their representatives to issue notices to squatters to vacate. Should the squatters refuse to comply, homeowners can file affidavits with law enforcement for their removal. This provision seeks to expedite the resolution process, safeguarding legitimate occupants and property owners alike.

Furthermore, the bill introduces measures to differentiate squatting from landlord-tenant relations. It establishes three distinct crimes to address various aspects of squatting: unlawful entry causing damage exceeding $1000, presenting false documents to unlawfully remain on a property, and engaging in fraudulent sale or lease of residential real estate.

The revised bill is now poised for consideration by the full House of Representatives, marking a significant step towards addressing the challenges posed by squatting in Alabama.
